Persons with higher education, confirmed by a specialist or master's diploma, are attached to universities, organizations of additional professional education and scientific organizations for a period of not more than 3 years.

These universities and organizations must have a dissertation council, which is granted the right to defend dissertations in the relevant scientific specialty by the Russian Ministry of Education and Science.

To consider issues related to attachment for the preparation of a dissertation, a special commission is created. It is formed from among scientific and scientific-pedagogical workers. Its composition is approved by the head of the university (organization).

A person submits to the name of the head of the university (organization) personal statement on attachment for the preparation of a dissertation. It must indicate the scientific specialty in which the dissertation is supposed to be written, contact information, the method of notification of the progress of consideration of the issue of attachment (by mail or in electronic form). Attached are copies of the passport and diploma, as well as a list published by the applicant (including in co-authorship) scientific works and (or) patents (certificates) received by him. The consent of the person to the processing of his personal data is recorded. There is a personal matter.

The commission selects the most capable and prepared persons for independent scientific (scientific and technical) activity. The decision is made within 30 working days.

A contract is concluded with the person who has passed the selection. It prescribes the conditions and terms for preparing the dissertation, other conditions that do not contradict the legislation of Russia. Further, an administrative act is issued on attaching a person to a university (organization), which is posted on the official website of the latter.

1. This Procedure establishes the rules for attaching persons with higher education, confirmed by a diploma of a specialist or master, for the preparation of a dissertation for the degree of candidate of science (hereinafter referred to as the dissertation) without mastering the training programs for scientific and pedagogical personnel in graduate school (adjuncture) (hereinafter referred to as attaching ) to educational organizations higher education, educational organizations of additional professional education and scientific organizations (hereinafter referred to as organizations).

2. Attachment for the preparation of a dissertation in a scientific specialty, provided for by the nomenclature of scientific specialties, approved by the Ministry of Education and Science of the Russian Federation 1 (hereinafter, respectively - scientific specialty, nomenclature), is allowed to the organization in which a council for the defense of dissertations for the degree of candidate of science has been created , for the degree of Doctor of Science (hereinafter referred to as the Dissertation Council), who is granted the right to defend dissertations in the relevant scientific specialty by the Ministry of Education and Science of the Russian Federation 2 .

3. To consider issues related to attachment for the preparation of a dissertation, a commission on attachment issues (hereinafter referred to as the commission) is created, the composition of which is approved by the head of the organization.

The composition of the commission is formed from among the scientific and scientific-pedagogical employees of the organization, and includes the chairman, deputy chairman, secretary and members of the commission. The chairman of the commission is the head or deputy head of the organization.

4. The attached person, within the time limits established by the organization for receiving the documents necessary to consider the issue of attachment for the preparation of a dissertation, submits a personal application for attachment to the head of the organization for the preparation of a dissertation (in Russian), which indicates the following information:

a) the name of the scientific specialty in which the attached person intends to prepare a dissertation, and its code in accordance with the nomenclature;

b) contact information: mailing address, phone (if available), fax (if available), address Email(in the presence of);

c) the method of informing about the progress of consideration of the issue of attachment (through postal operators of general use or in electronic form).

5. The application for attachment for the preparation of a dissertation is accompanied by:

a) a copy of the identity document of the attached person;

b) a copy of the diploma of a specialist or a master, the holder of which is the attached person, and its annexes;

c) a list (in Russian) of scientific papers and (or) received patents (certificates) for utility model, patents for an industrial design, patents for selection achievements, certificates for programs for electronic computers, databases, topologies of integrated circuits registered in the prescribed manner, signed by the attached person (if any);

In the case of a personal appeal, the attached person shall present the originals of these documents. In this case, their copies are made by the commission itself.

6. In the application for attachment for the preparation of a thesis, the fact of the consent of the attached person to the processing of his personal data contained in the documents and materials submitted by him for consideration of the issue of attachment for the preparation of a dissertation is recorded in the manner established by the legislation of the Russian Federation on personal data 3 .

The fact of consent is certified by the personal signature of the attached person.

7. If the attached person submits an application that does not contain all the information provided for in paragraph 4 of this Procedure, and (or) submits the documents necessary to consider the issue of attaching for the preparation of a dissertation, the organization does not return the documents to the attached person in full.

8. When accepting the documents necessary to consider the issue of attaching for the preparation of a dissertation, a personal file is opened for each attaching person, in which all documents and materials submitted by him, as well as materials generated in the process of considering the issue of attaching, are stored.

In the case of attachment to the organization, the materials formed in the process of preparing the dissertation by the attached person are also entered in the personal file.

9. If in the process of reviewing the documents and materials submitted by the attached person for making a decision on attaching for the preparation of a dissertation, the facts of providing false information are revealed, in relation to this person the commission decides to refuse to attach.

10. In order to attach for the preparation of a dissertation the most capable and prepared for independent scientific (scientific and technical) activities, the commission selects among the persons who submitted the documents necessary to consider the issue of attachment for the preparation of a dissertation.

11. Based on the results of the selection, no later than 30 working days from the date of receipt of the documents necessary to consider the issue of attaching for the preparation of a dissertation, the organization notifies the attaching person of the decision taken by the commission to attach or refuse to attach (with justification of the decision to refuse to attach ) in the manner specified in the application of the attaching person.

12. Within 10 working days after the commission makes a decision on attaching a person, an agreement is concluded with this person on attaching for the preparation of a dissertation, which, among other things, indicates the conditions and term for preparing a dissertation, other conditions that do not contradict the legislation of the Russian Federation.

13. Within 10 working days after the conclusion of the agreement on attachment for the preparation of a dissertation, the head of the organization issues an administrative act on attaching a person to the organization (hereinafter referred to as the administrative act).

14. The administrative act is posted on the official website of the organization on the Internet within 3 working days after its publication for a period of 3 years.

15. Persons attached to the organization in accordance with the administrative act and the contract are notified of this within 5 working days after the issuance of the administrative act in the manner indicated in the application for attachment for the preparation of the dissertation.

According to paragraph 3 of clause 2 of the Regulation on the award of academic degrees, approved by the Decree of the Government of the Russian Federation of September 24, 2013 No. 842 (hereinafter - Regulation No. 842), a dissertation for the degree of Doctor of Science can be prepared in doctoral studies. At the same time, scientific and pedagogical workers have such an opportunity.

The dissertation can be prepared in doctoral studies only by those educational organizations higher education, educational organizations of additional professional education and scientific organizations in which dissertation councils have been established.

The dissertation for the degree of Doctor of Science can be prepared outside of doctoral studies. In accordance with paragraph 2 of clause 2 of Regulation No. 842, the applicant may prepare a dissertation for the degree of Doctor of Science based on the results of their scientific research, i.e. on one's own.

According to paragraph 3 of clause 16 of Regulation No. 842, the applicant for a scientific degree has the right to submit a dissertation for defense to any dissertation council.

At the same time, the scientific specialty in which the dissertation was completed must correspond to the scientific specialty and branch of science for which the dissertation council has been granted the right to defend dissertations by the Ministry of Education and Science of the Russian Federation.

In accordance with clause 18 of Regulation No. 842, the dissertation council is obliged to accept the dissertation for preliminary consideration if there is a positive conclusion from the organization where the dissertation was carried out and the documents provided for by the list approved by the Ministry of Education and Science of the Russian Federation, and also subject to the placement of the full text by the applicant for the academic degree dissertations on the official website of the organization on the basis of which the dissertation council was created, on the Internet.

"Article 41. Preparation of dissertations for the degree of candidate of science, the degree of doctor of science

2. Persons who have the degree of Candidate of Science and have prepared a dissertation for the degree of Doctor of Science on the basis of the results of their scientific research are allowed to compete for the degree of Doctor of Science.

Dissertation for the degree of Doctor of Sciences by scientific and teaching staff can be prepared in doctoral studies of organizations that have established councils for the defense of dissertations for the degree of candidate of science, for the degree of doctor of science.

The regulation on doctoral studies, including the procedure for sending to doctoral studies, the requirements for employees sent to doctoral studies, the duration of stay in doctoral studies, as well as the amount and procedure for monthly payments to such employees are established by the Government of the Russian Federation.

3. Persons admitted to the competition for the degree of Candidate of Science or Doctor of Science, at their main place of work in the manner established by the Government of the Russian Federation, are granted leave with the preservation of the average wages lasting three and six months, respectively.

Article 163

1. This Federal Law shall enter into force on September 1, 2013, except for the provisions for which this article establishes a different date for their entry into force.

3. Admission to doctoral studies in accordance with the admission procedure that was in effect before the day this Federal Law came into force is carried out until January 1, 2014. The training of persons admitted to doctoral studies before January 1, 2014 is carried out before the expiration of their training period, but no later than January 1, 2018. This period does not include the defense of a dissertation for the degree of Doctor of Science.

7. Awarding the degree of Doctor of Science and issuance of a diploma of the degree of Doctor of Science to persons whose dissertation for the degree of Doctor of Science was accepted by the Council for the defense of dissertations for the degree of Candidate of Science, for the degree of Doctor of Science before the date of entry into force of this of the Federal Law shall be carried out in accordance with the procedure established prior to the date of entry into force of this Federal Law, but no later than January 1, 2014.
