P.4 Art. 24.6 of Law 89-FZ regulates the issue of obtaining the status of a regional operator for the collection and disposal of solid household waste.
The article provides that the entrepreneur must win a tender organized by the regional administration. Only legal entities can participate in the competition.
Basic requirements for the participants of the competition:
- official registration of a business entity;
- have a license for appropriate kind works;
- lack of procedure for the liquidation of the enterprise or bankruptcy proceedings;
- no tax debts.
The package of documents for participation in the competition includes:
- A valid extract from the Unified State Register of Legal Entities listing the relevant codes.
- A document confirming the rights of the applicant.
- Copies of constituent documents with all seals and signatures of the company's managers.
The winner of the competition is the company that offers the most favorable conditions for the execution of the agreement set out in the application.

OKPD 2: Services for the removal of solid waste
OKPD 2 was introduced in pursuance of Order No. 14 of Rosstandart dated January 31, 2014, thereby replacing OKPD, OKP and OKUN. The same order introduced OKVED 2, which replaced OKVED 2001 and 2007.
These two classifiers “consider” the activities of the entrepreneur from two sides, since they have different purposes:
- OKVED is a classifier of types of activity, and OKPD-2 is a classifier of types of products;
- codes from OKPD-2 are assigned independently, and OKVED-2 is entered in the public register by the body in which registration takes place;
- using OKVED, information is encoded in the Unified State Register of Legal Entities, and OKPD-2 encoding is used when placing government orders, as well as to ensure the functioning state system contracting.
All these codes are necessary for the preparation of regulations that regulate various areas of economic activity, as well as for the formation of statistical information at the international level.
Services for the removal of municipal solid waste (MSW) are included in group 38 under OKPD-2, as well as under OKVED. When conducting public procurement for the service of collection and removal of solid waste, OKPD-2 codes are applied.
In the documents provided for participation in the auction, in addition to other mandatory information, the OKPD-2 code of the service purchased by the public procurement organizer is indicated:
- When purchasing a service for the removal of solid waste, the OKPD-2 code 38.11.11 "Collection of non-hazardous municipal waste suitable for reuse: cardboard, paper, plastic, etc." is applied.
- If waste unsuitable for further use is collected and removed, then such garbage collection will be indicated by the code 38.11.21.
- If it is necessary to process and dispose of garbage, a code from group 38.2 is applied.
OKPD-2 also includes codes for different kinds waste, for example, glass - 38.11.51. And the export of MSW of medical origin is designated by the code 38.12.11.
The provision of services for the removal of solid waste from 2017 is carried out under the contract paid provision service that has the following features:
- the contract is drawn up between residents of an apartment building, as well as the private sector, management organizations, HOAs and a regional operator;
- removal and disposal of solid waste is also paid by the owners of non-residential premises;
- the agreement is in writing;
- the contract is concluded for the entire period of validity of the status of a regional operator (from 10 years) or less. If this status is lost, the contract is automatically extended with its successor.

The signing of the contract is possible no earlier than 10 days from the date of publication of the Minutes of Summing Up (PIP) in the Unified Information System (UIS).
Strictly follow the deadlines. The ratio of working days and days off is not important:
Not more than 5 days from the date of publication of the Minutes of Summing Up (PPI) in the Unified Information System (UIS) - the Customer publishes the draft contract.
Not more than 5 days from the date of publication by the Customer of the draft contract - the Winner publishes the protocol/draft contract. The winner who did not send the protocol of disagreements or did not send the signed draft contract after 13 days from the date of publication of the Protocol of Summing Up the Results (SIP) in the Unified Information System (UIS) is recognized as having evaded signing the contract.
